MEGADETH: DAVID ELLEFSON's $18.5 Million Lawsuit Dismissed
January 16, 2005The MEGADETH lawsuit that one founder of the thrash band lodged against the other is "megadead," according to the New York Daily News.
Former MEGADETH bassist David Ellefson had sued frontman Dave Mustaine for $18.5 million over the pair's bitter falling out (see previous BLABBERMOUTH.NET stories: Story#1, Story#2, Story#3).
Manhattan Federal Court Judge Naomi Buchwald dismissed the lawsuit Thursday (Jan. 13),saying Ellefson had agreed to a deal to resolve their various disputes after the heavy metal act broke up in 2002. Ellefson had maintained he backed out at the last minute.
The suit charged that Mustaine had been in and out of drug rehab at least 17 times and resented Ellefson because the bassist had managed to kick his own habit without a relapse.
The band reformed in 2004 without Ellefson.
